Delaware finds wide support for its Supreme Court battle over judical balance

Late last year, the U.S. Supreme Court agreed to review lower court decisions striking down Delaware’s judicial balance requirement.

Now, we have a date for oral arguments - March 25th

In the run up to those arguments next month, a number of people and groups have filed amicus briefs and they all back the state’s argument the lower court decisions should be reversed. 

Widener University Delaware Law School constitutional law professor Alan Garfield rejoins us this week with to discuss these briefs and the potential impact they could have.

Note: Garfield joined a group of law professors signing on to one of the briefs filed.  That brief was written by Widener Delaware Law School Dean Rod Smolla offering support for Delaware’s legal argument in this case.
