No new bail hearing will be given for a man who spent 25 years on death row, but now awaits a new trial.
Jermaine Wright has spent nearly all of his adult life awaiting his execution after he was convicted in 1992 of shooting a liquor store employee to death outside of Wilmington.
He was eventually released last year after a Superior Court judge found the state’s evidence to be lacking, which included a heroin-fueled confession and an anonymous note accusing Wright of the crime.
The state Supreme Court ordered a new trial in January, with Wright headed back behind bars.
An order from Superior Court Judge Eric Davis this week says new evidence is needed to prompt a bail hearing and that reshaping existing arguments isn’t enough.
A lawyer for Wright says he’s disappointed about the order, but that an upcoming retrial will be “the first time he’ll get a fair trial after 25 years on death row.”
That trial is scheduled for next spring.
