Wilmington police complete investigation into McDole shooting

One probe into the death of Jeremy McDole is complete, but what it found is not being released just yet.

Wilmington Police say they have wrapped up their internal investigation into what happened when the 28 year-old McDole was shot and killed by officers last September.

But they are not ready to discuss their report – saying they can't comment until all investigations are complete. The state Department of Justice’s Office of Civil Rights and Public Trust is conducting its own separate investigation. And Wilmington police say they have given their findings to the state DOJ.

The police have previously said McDole had already shot himself before officers arrived and they shot him after he refused to show his hands.

McDole’s family has filed a wrongful death lawsuit against the City of Wilmington.  The city is moving to dismiss the suit, citing in court documents a report that McDole’s right hand and sleeve had gunshot residue on them,  as well as a cell phone video depicting the shooting.

The court documents also indicate Wilmington police officers say they found a .38 caliber revolver in the wheelchair bound man’s underwear after he was shot, which had two live rounds and four spent casings.

McDole’s family says the shooting was a racially motivated killing and rejects allegations that McDole shot himself before being fired on by police.
