State gives Peninsula Compost additional time to shutdown

DNREC has extended the closure deadline of the Peninsula Compost facility in Wilmington by three months.

DNREC Secretary David Small issued a Conciliation Order that requires the Wilmington Organic Recycling Center to shut down by June 30th. If the facility fails to comply by that date, the Peninsula Compost Company will have to pay a penalty of $10,000 dollars per day that it does not complete closure activities.

Peninsula had requested an extension from DNREC earlier this year. In a letter to Secretary Small, the company cited operational and resource facilitations that would make it difficult for the facility to meet the schedule that was set forth by DNREC’s original order to cease operations.

Under the terms Secretary Small’s order, the Peninsula Compost Company has agreed to drop its appeal of DNREC’s original closure order and waive its right to appeal the conciliation order. Currently, the majority of material remaining at the site is finished compost and not food wastes and feedstock that may have contributed to significant odors from the site in the past.
