Florida court rejects AG Biden's appeal in Nemours Foundation case

A Florida appeals court ruled against Delaware Attorney General Beau Biden Wednesday in a case involving how funds from the Nemours Foundation are spent.

Biden filed papers in 2012 contending a 2004 reorganization by the current trustees’ of the $4 billion foundation reduced Delaware’s influence and shifted its focus to Florida to the detriment of First State beneficiaries. A trial court rejected that charge, a decision Biden appealed.

The 2-1 appeals court ruling said Biden failed to prove the trial court abused its discretion.

The Nemours Foundation runs the A.I duPont Hospital for Children in Wilmington, as well as the Nemours Mansion and grounds. It also runs a number of healthcare facilities in New Jersey, Pennsylvania and Florida.
