DNREC and owners of the Delaware City refinery have reached a settlement over alleged water-related violations at the plant.
Delaware City Refining Company will install modern technology to reduce the refinery’s impact on aquatic life in the Delaware River - including an improved fish return system at its water intake structure.
Refinery owners are also agreeing to an expedited schedule make the changes.
The first of three new modified traveling screens, considered by EPA to be a best technology available to minimize the impact of the refinery’s water cooling system on fish, will be installed by May of next year. All three screens and a new fish return system must be up and running by June 2017.
The agreement covers numerous violations that have occurred since the Delaware City Refining Company restarted the refinery in 2011.
$116,000 in penalties for the alleged violations will be waived if all terms of the agreement are met.
