A Kent County company has been slapped with the State’s first-ever environmental chronic violation complaint.
Delaware's Department of Natural Resources and Environmental Control (DNREC) says Mike Davidson Enterprises, a recycling and resource recovery facility near Camden has repeatedly ignored compliance orders and failed to clean up its site even after its permit was revoked last August.
The Chronic Violator Complaint was served by the Delaware Department of Justice and the Attorney General’s Office and seeks over eight million dollars in restitution to cover the costs of loading, transportation and proper disposal of more than one hundred thousands tons of material from the site. The order also imposes up to 10,000 dollars per day in additional fines.
DNREC Secretary Collin O’Mara called out the company last summer for what he called a blatant disregard to protect public health – citing improper storage and failure to dispose of over 100,000 tons of waste. O’Mara says the new action against the company is an enforcement tool of last resort.
The chronic violator complaint notes violations against the company date back to January 2010. One of O’Mara’s orders from 2012 stated that Mike Davidson Enterprises had chosen to operate their facility as an unauthorized landfill and not the recycling facility that was originally intended.
