DNREC has handed Summit Aviation in Middletown a substantial fine for violating state laws regarding hazardous waste management.
DNREC Secretary Collin O’Mara is ordering Summit to pay $81,426 and $12,214 in cost recovery to the agency.
The penalty stems from a site assessment in late September during which DNREC found 18 violations – including operating a hazardous waste containment building without meeting the necessary engineering design criteria, failure to properly label and close containers of hazardous waste and used oil.
Summit Aviation was cited for not having an adequate contingency plan to address a potential hazardous waste spill or release and failure to properly train employees handling hazardous waste.
Summit Aviation has 30 days to appeal the decision.
