A Kent County Family Court commissioner has denied to reopen a civil protection order involving NASCAR driver Kurt Busch - according to The News Journal.

The Delaware Department of Justice said last month that there was not enough evidence or witnesses to bring criminal charges against Busch, who was accused of assaulting his girlfriend Patricia Driscoll in September of last year while in a trailer at the Dover International Speedway.A state Family Court judge still signed off on a no-contact order in favor of Driscoll in February. Busch has repeatedly denied the charges. His attorneys filed the motion to reopen the order after the ruling.

Busch temporarily suspended from  NASCAR last month, but was reinstated last week.
